This page intends to make our requirements and processes transparent as we continue to work to ensure compliance with the Illinois Student Online Personal Protection Act (SOPPA). Documents explaining these various laws are linked on this page.
Data Privacy Laws
Children’s Internet Protection Act (CIPA)
This law imposes specific requirements on schools that utilize the federal E-Rate program to receive discounts for internet access and other technology services or that receive federal grants for other technology expenses. Content filtering on devices issued to or accessed by students is implemented to comply with this law.
Children’s Online Privacy Protection Act (COPPA)
It restricts the collection of personal information from children under 13 by companies operating websites, games, mobile applications, and digital services that are directed to children or that collect personal information from individuals known to be children. Content filtering systems may proactively prevent students from accessing these resources.
Family Educational Rights and Privacy Act (FERPA)
Governs information in a student’s education record, restricting access and use of student information.
Illinois School Students Records Act (ISSRA)
The Illinois School Student Records Act (ISSRA) is a state law similar to FERPA. Also, it affords parents/guardians rights concerning their children's school student records and the individually identifiable information in those records. Like FERPA, the two primary purposes of the ISSRA are to ensure parent/guardian access to their child’s records and the confidentiality of student records and the information in those records.
Protection of Pupil Rights Amendment (PPRA)
The Protection of Pupil Rights Amendment (PPRA) is a federal law that affords certain rights to parents of minor students regarding surveys that ask questions of a personal nature.
Illinois Student Online Personal Protection Act (SOPPA)
Effective July 1, 2021. Guarantees that student data is protected when collected by educational technology companies and that data is used for beneficial purposes only.
What is SOPPA?
What happens to the student data that we send to a third-party vendor? Information like names, birthdates, etc., may be provided by Liberty to third parties like ALEKS, Edgenuity, IXL, etc. What protections do those companies have to ensure that our students' data is not sold or freely given to others? This is exactly what SOPPA looks to address.
As part of SOPPA, these companies must enter into Data Privacy Agreements (DPA) with each district they work with. These agreements outline what data is stored, how it is protected, what the company can and cannot do with it, and what it will do in case of a data breach.
Liberty CUSD 2 leverages the Student Data Privacy Consortium (SDPC), a unique collaborative of schools, districts, and providers that addresses real-world, adaptable, and implementable solutions to growing data privacy concerns.
